THE CIVIL STATE
자연상태에서 시민상태로 넘어가면 인간에게 매우 두드러진 변화가 일어난다. 행동에서 본능을 정의로 대체하고, 이전에는 없었던 도덕성을 행위에 부여한다. 그제야 의무의 목소리가 육체적 충동을, 권리가 욕망을 대신한다. 지금까지 자기 자신만 고려하던 인간은 다른 원리에 따라 행동하고 기호에 귀 기울이기 전에 이성과 상의하도록 강제된다.

The passage from the state of nature to the civil state produces a very remarkable change in man, by substituting justice for instinct in his conduct, and giving his actions the morality they had formerly lacked. Then only, when the voice of duty takes the place of physical impulses and right of appetite, does man, who so far had considered only himself, find that he is forced to act on different principles, and to consult his reason before listening to his inclinations.
이 상태에서 인간은 자연에서 얻었던 몇 가지 이점을 잃지만 그보다 훨씬 큰 것을 얻는다. 능력은 자극받고 발전하며, 관념은 넓어지고, 감정은 고상해지며, 영혼 전체가 높아진다. 이 새로운 상태의 남용이 그를 이전보다 더 낮게 떨어뜨리는 일이 자주 없었다면, 인간은 자신을 영원히 그 상태에서 끌어내어 우둔하고 상상력 없는 동물에서 지적 존재이자 인간으로 만든 행복한 순간을 끊임없이 축복했을 것이다.

Although, in this state, he deprives himself of some advantages which he got from nature, he gains in return others so great, his faculties are so stimulated and developed, his ideas so extended, his feelings so ennobled, and his whole soul so uplifted, that, did not the abuses of this new condition often degrade him below that which he left, he would be bound to bless continually the happy moment which took him from it for ever, and, instead of a stupid and unimaginative animal, made him an intelligent being and a man.
전체 손익을 비교 가능한 말로 정리해 보자. 인간이 사회계약으로 잃는 것은 자연적 자유와 자신이 얻으려 하고 실제로 얻을 수 있는 모든 것에 대한 무제한의 권리다. 얻는 것은 시민적 자유와 자신이 소유한 모든 것에 대한 소유권이다.

Let us draw up the whole account in terms easily commensurable. What man loses by the social contract is his natural liberty and an unlimited right to everything he tries to get and succeeds in getting; what he gains is civil liberty and the proprietorship of all he possesses.
둘을 잘못 비교하지 않으려면 개인의 힘만으로 제한되는 자연적 자유와 일반의지로 제한되는 시민적 자유를 분명히 구별해야 한다. 또한 힘의 결과이거나 선점자의 권리일 뿐인 점유와 오직 실정적 권원에 기초할 수 있는 소유권도 구별해야 한다.

In order that we may make no mistake in weighing one against the other, we must clearly distinguish natural liberty, which is bounded only by the strength of the individual, from civil liberty, which is limited by the general will; and possession, which is merely the effect of force or the right of the first occupier, from property, which can be founded only on a positive title.
여기에 시민상태에서 인간이 얻는 도덕적 자유를 더할 수 있다. 오직 이 자유만이 인간을 진정한 자기 주인으로 만든다. 욕망의 충동에 따르는 것은 노예 상태이고, 우리가 스스로 정한 법에 복종하는 것은 자유이기 때문이다. 그러나 이 문제는 이미 충분히 말했으며, 자유라는 말의 철학적 의미는 지금의 관심사가 아니다.

We might, over and above all this, add, to what man acquires in the civil state, moral liberty, which alone makes him truly master of himself; for the mere impulse of appetite is slavery, while obedience to a law which we prescribe to ourselves is liberty. But I have already said too much on this head, and the philosophical meaning of the word liberty does not now concern us.
