THE RIGHT OF THE STRONGEST
가장 강한 자도 힘을 권리로, 복종을 의무로 바꾸지 않는다면 언제까지나 주인으로 남을 만큼 강하지는 못하다. 여기서 이른바 최강자의 권리가 나온다. 겉보기에는 풍자처럼 들리지만 실제로는 근본 원리로 제시된다. 그러나 이 표현을 설명해 줄 사람은 없는가? 힘은 물리적 능력이며, 나는 그것이 어떤 도덕적 효과를 낳는지 알 수 없다. 힘에 굴복하는 것은 의지가 아니라 필요의 행위이고, 기껏해야 신중함의 행위다. 어떤 의미에서 그것이 의무가 될 수 있는가?

The strongest is never strong enough to be always the master, unless he transforms strength into right, and obedience into duty. Hence the right of the strongest, which, though to all seeming meant ironically, is really laid down as a fundamental principle. But are we never to have an explanation of this phrase? Force is a physical power, and I fail to see what moral effect it can have. To yield to force is an act of necessity, not of will—at the most, an act of prudence. In what sense can it be a duty?
잠시 이른바 권리가 존재한다고 가정해 보자. 그 결과는 설명할 수 없는 모순의 집합일 뿐이다. 힘이 권리를 만든다면 원인이 바뀔 때 결과도 바뀐다. 처음의 힘보다 더 큰 모든 힘은 그 권리를 이어받는다. 처벌받지 않고 불복할 수 있게 되는 순간 불복종은 정당해진다. 언제나 가장 강한 자가 옳다면 중요한 것은 오직 가장 강해지는 일뿐이다.

Suppose for a moment that this so-called "right" exists. I maintain that the sole result is a mass of inexplicable nonsense. For, if force creates right, the effect changes with the cause: every force that is greater than the first succeeds to its right. As soon as it is possible to disobey with impunity, disobedience is legitimate; and, the strongest being always in the right, the only thing that matters is to act so as to become the strongest.
힘이 사라지면 함께 사라지는 권리가 무슨 권리인가? 강제로 복종해야 한다면 의무 때문에 복종할 필요가 없고, 강제되지 않는다면 복종할 의무도 없다. 분명히 ‘권리’라는 말은 힘에 아무것도 더하지 않으며, 이 맥락에서는 전혀 의미가 없다.

But what kind of right is that which perishes when force fails? If we must obey perforce, there is no need to obey because we ought; and if we are not forced to obey, we are under no obligation to do so. Clearly, the word "right" adds nothing to force: in this connection, it means absolutely nothing.
‘현존하는 권력에 복종하라.’ 이것이 힘에 굴복하라는 뜻이라면 좋은 교훈이지만 불필요하다. 결코 어겨지지 않을 것이라고 내가 보증할 수 있기 때문이다. 모든 권력이 신에게서 온다는 점은 인정한다. 그러나 모든 질병도 신에게서 온다. 그렇다면 의사를 부르는 것이 금지되는가? 숲 가장자리에서 강도가 나를 덮친다면 강제로 지갑을 내주어야 할 뿐 아니라, 그것을 지킬 수 있어도 양심상 내줄 의무가 있는가? 그가 든 권총도 분명 하나의 권력이기 때문이다.

Obey the powers that be. If this means yield to force, it is a good precept, but superfluous: I can answer for its never being violated. All power comes from God, I admit; but so does all sickness: does that mean that we are forbidden to call in the doctor? A brigand surprises me at the edge of a wood: must I not merely surrender my purse on compulsion; but, even if I could withhold it, am I in conscience bound to give it up? For certainly the pistol he holds is also a power.
그러므로 힘은 권리를 만들지 않으며 우리는 정당한 권력에만 복종할 의무가 있다고 인정하자. 그러면 처음의 질문이 다시 돌아온다.

Let us then admit that force does not create right, and that we are obliged to obey only legitimate powers. In that case, my original question recurs.
