제2권 제2장 주권은 분할할 수 없다
주권은 양도될 수 없는 것과 같은 이유로 분할될 수도 없다. 의지는 일반적이거나 그렇지 않거나 둘 중 하나이기 때문이다. 그것은 인민 전체의 의지이거나 일부의 의지다. 전자의 경우 선언된 의지는 주권의 행위이며 법을 이룬다. 후자의 경우에는 개별의지나 행정관의 행위일 뿐이며, 많아야 하나의 명령에 지나지 않는다.

Sovereignty, for the same reason as makes it inalienable, is indivisible; for will either is, or is not, general; it is the will either of the body of the people, or only of a part of it. In the first case, the will, when declared, is an act of Sovereignty and constitutes law: in the second, it is merely a particular will, or act of magistracy—at the most a decree.
그러나 정치이론가들은 원리상 주권을 나눌 수 없자 그 대상을 따라 나눈다. 그들은 주권을 힘과 의지, 입법권과 집행권, 과세권·사법권·전쟁권, 국내 행정권과 외국과 조약을 맺는 권한으로 구분한다.

But our political theorists, unable to divide Sovereignty in principle, divide it according to its object: into force and will; into legislative power and executive power; into rights of taxation, justice and war; into internal administration and power of foreign treaty.
Sometimes they confuse all these sections, and sometimes they distinguish them; they turn the Sovereign into a fantastic being composed of several connected pieces: it is as if they were making man of several bodies, one with eyes, one with arms, another with feet, and each with nothing besides.
정치이론가들의 재주는 이와 비슷하다. 먼저 장터의 눈속임에나 어울릴 환상으로 정치체를 해체한 뒤, 어떻게 했는지도 모르게 다시 결합한다.
이 오류는 주권적 권위에 관한 정확한 개념이 부족하고, 주권에서 흘러나오는 것에 불과한 행위를 주권의 일부로 보았기 때문에 생긴다. 예컨대 전쟁을 선포하고 평화를 맺는 행위는 주권 행위가 아니다. 그것은 법을 만드는 것이 아니라 법을 적용하는 개별적 행위다.

The conjuring tricks of our political theorists are very like that; they first dismember the body politic by an illusion worthy of a fair, and then join it together again we know not how.
This error is due to a lack of exact notions concerning the Sovereign authority, and to taking for parts of it what are only emanations from it. Thus, for example, the acts of declaring war and making peace have been regarded as acts of Sovereignty; but this is not the case, as these acts do not constitute law, but merely the application of a law, a particular act which decides how the law applies.
정치적 권리를 다룬 저술가들이 이런 부정확한 원리를 가지고 왕과 인민의 권리를 판단했을 때 얼마나 많은 혼란을 낳았는지는 헤아리기 어렵다. 진정한 원리를 받아들였다면 많은 난점은 사라졌겠지만, 그 진실은 인민 외에는 누구에게도 아첨하지 않았을 것이다. 진실은 출세로 가는 길이 아니며 인민은 대사직이나 교수직이나 연금을 나누어 주지 않는다.

It would be impossible to estimate the obscurity this lack of exactness has thrown over the decisions of writers who have dealt with political right, when they have used the principles laid down by them to pass judgment on the respective rights of kings and peoples.
If these writers had adopted the true principles, all difficulties would have been removed, and they would have been always consistent; but it would have been a sad truth for them to tell, and would have paid court for them to no one save the people. Moreover, truth is no road to fortune, and the people dispenses neither ambassadorships, nor professorships, nor pensions.
