가장 잘 구성된 정부도 자연스럽고 피할 수 없는 쇠퇴 경향을 가진다. 스파르타와 로마조차 사라졌다면 어떤 국가도 영원히 지속되리라 기대할 수 없다.

오래가는 정부를 만들고자 한다면 영원한 정부를 만들겠다는 생각부터 버려야 한다. 인간이 만든 것에 인간 조건이 허락하지 않는 안정성을 부여하려 해서는 안 된다.

Such is the natural and inevitable tendency of the best constituted governments. If Sparta and Rome perished, what State can hope to endure for ever?

If we would set up a long-lived form of government, let us not even dream of making it eternal. If we are to succeed, we must not attempt the impossible, or flatter ourselves that we are endowing the work of man with a stability of which human conditions do not permit.

인간의 신체 구성은 자연의 작품이고 국가의 헌정은 인간 기술의 작품이다. 인간은 자기 수명을 마음대로 늘릴 수 없지만, 가장 좋은 헌정을 부여함으로써 국가의 생명을 가능한 한 오래 연장할 수 있다.

가장 잘 구성된 국가도 언젠가는 끝나지만, 뜻밖의 사고로 때 이른 파괴를 당하지 않는다면 다른 국가보다 늦게 끝날 것이다.

The body politic, as well as the human body, begins to die as soon as it is born, and carries in itself the causes of its destruction. But both may have a constitution that is more or less robust and suited to preserve them a longer or a shorter time.

The constitution of man is the work of nature; that of the State the work of art. It is not in men's power to prolong their own lives; but it is for them to prolong as much as possible the life of the State, by giving it the best possible constitution.

The best constituted State will have an end; but it will end later than any other, unless some unforeseen accident brings about its untimely destruction.

The life-principle of the body politic lies in the sovereign authority. The legislative power is the heart of the State; the executive power is its brain, which causes the movement of all the parts.

The brain may become paralysed and the individual still live. A man may remain an imbecile and live; but as soon as the heart ceases to perform its functions, the animal is dead.

국가는 개별 법률이 아니라 입법권에 의해 존속한다. 어제의 법이 오늘을 스스로 구속하는 것은 아니지만, 주권자가 폐지할 수 있는데도 폐지하지 않은 법은 침묵에 의한 동의로 계속 확인된다.

주권자가 한 번 의지한다고 선언한 것은 그 선언을 철회할 때까지 계속 의지하는 것으로 간주된다.

오래된 법이 존중받는 이유도 여기에 있다. 오랜 기간 보존되었다는 것은 주권자가 그 법을 계속 유익하다고 인정했다는 뜻이다. 잘 구성된 국가에서는 법이 오래될수록 권위를 더하지만, 오래될수록 약해지는 곳에서는 입법권이 이미 사라졌고 국가는 죽은 것이다.

The State subsists by means not of the laws, but of the legislative power. Yesterday's law is not binding to-day; but silence is taken for tacit consent, and the Sovereign is held to confirm incessantly the laws it does not abrogate as it might. All that it has once declared itself to will it wills always, unless it revokes its declaration.

Why then is so much respect paid to old laws? For this very reason. We must believe that nothing but the excellence of old acts of will can have preserved them so long: if the Sovereign had not recognised them as throughout salutary, it would have revoked them a thousand times.

This is why, so far from growing weak, the laws continually gain new strength in any well constituted State; the precedent of antiquity makes them daily more venerable: while wherever the laws grow weak as they become old, this proves that there is no longer a legislative power, and that the State is dead.
