인민이 주권자로서 적법하게 모이는 순간 정부의 관할권은 완전히 멈추고 집행권도 정지된다. 대표되는 당사자가 직접 나와 있으므로 대표자는 더 이상 존재하지 않으며, 가장 평범한 시민의 인격도 최고 집정자의 인격만큼 신성하고 침해할 수 없다.
로마 민회에서 일어난 많은 소요는 이 원칙을 모르거나 무시한 데서 비롯되었다. 집정관은 인민 집회의 의장에 지나지 않았고, 호민관은 발언자에 불과했으며, 원로원은 아무 권한도 행사하지 못했다.

The moment the people is legitimately assembled as a sovereign body, the jurisdiction of the government wholly lapses, the executive power is suspended, and the person of the meanest citizen is as sacred and inviolable as that of the first magistrate; for in the presence of the person represented, representatives no longer exist. Most of the tumults that arose in the comitia at Rome were due to ignorance or neglect of this rule.
The consuls were in them merely the presidents of the people; the tribunes were mere speakers; the senate was nothing at all.
군주나 정부는 자신보다 실제로 우월한 권위를 인정해야 하는 이러한 정지 기간을 언제나 두려워한다. 인민 집회는 정치체의 방패이자 정부의 굴레이므로, 통치자들은 시민이 모이지 못하게 하려고 온갖 노력과 반론, 방해와 약속을 아끼지 않는다.
시민이 탐욕스럽고 비겁하며 자유보다 안락을 더 사랑하면 정부의 거듭된 압력에 오래 맞서지 못한다. 저항하는 힘이 계속 약해지는 동안 주권은 끝내 사라지고, 대부분의 도시는 제 수명보다 일찍 무너진다.

These intervals of suspension, during which the prince recognises or ought to recognise an actual superior, have always been viewed by him with alarm; and these assemblies of the people, which are the aegis of the body politic and the curb on the government, have at all times been the horror of rulers: who therefore never spare pains, objections, difficulties, and promises, to stop the citizens from having them.
When the citizens are greedy, cowardly, and pusillanimous, and love ease more than liberty, they do not long hold out against the redoubled efforts of the government; and thus, as the resisting force incessantly grows, the sovereign authority ends by disappearing, and most cities fall and perish before their time.
그러나 주권과 자의적 정부 사이에는 때때로 중간적 권력이 끼어든다. 이제 그 문제를 살펴보아야 한다.
